The terms of any Publishing Agreement shall take precedence over these Terms in respect of the specific services provided under that agreement.

Nothing in these Terms constitutes an offer to provide publishing services or creates a contractual relationship beyond access to and use of this website unless and until a Publishing Agreement is formally executed.

Copyright Ownership

Unless expressly agreed otherwise in a written Publishing Agreement:

  • Authors retain 100% copyright ownership;
  • ISBN assignment or publisher-of-record designation does not transfer copyright.
Royalties

Unless expressly agreed otherwise in writing:

  • Authors retain 100% of royalties generated via third-party retail platforms;
  • Royalties are paid directly by such platforms to the author’s own bank account;
  • Noble Legacy does not receive, hold, or distribute royalties.
ISBN Assignment and Publisher of Record

Where Noble Legacy assigns an ISBN from its registered publisher block:

  • Noble Legacy is listed as publisher of record in bibliographic databases;
  • Such designation reflects bibliographic registration and statutory compliance;
  • ISBN assignment does not transfer copyright ownership.
Legal Deposit

Where Noble Legacy is publisher of record, it fulfils obligations under the Legal Deposit Libraries Act 2003. Legal deposit does not affect copyright ownership or royalty entitlement.

Platform Accounts
  • Distribution occurs through accounts owned and controlled by the author;
  • Where authorised in writing, Noble Legacy may assist with configuration or upload;
  • Such assistance does not create partnership, fiduciary duty, or financial control;
  • Authors remain responsible for compliance with platform terms and monitoring sales and tax obligations.
Editorial Discretion

Noble Legacy reserves the right, prior to execution of a Publishing Agreement or prior to publication, to decline or withdraw from publication where legal, reputational, or editorial concerns arise.

No Guarantee of Commercial Outcome

Noble Legacy does not guarantee:

  • sales volume or revenue;
  • rankings or chart position;
  • reviews or media coverage;
  • commercial success.

Publishing outcomes are influenced by market conditions beyond Noble Legacy’s control.

Scope of Services

Specific services, timelines, deliverables, and responsibilities are defined exclusively in individual Publishing Agreements.

7. Fees and Payments

Fees are determined individually and set out in written Publishing Agreements.

Payment terms are defined in those agreements.

Payments may be processed via bank transfer or regulated third-party providers. Noble Legacy does not store payment card details.

Consumer Rights and Cancellation

Where the author is acting as a consumer within the meaning of applicable consumer protection legislation:

  • Statutory cancellation rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 may apply;
  • Where services are requested to begin during a statutory cancellation period, the author may be required to provide express consent and acknowledgement that cancellation rights may be reduced once performance has commenced;
  • Nothing in these Terms excludes or limits rights under the Consumer Rights Act 2015 or other applicable consumer legislation.

Refund provisions are governed by the relevant Publishing Agreement.

8. Author Warranties

Authors entering a Publishing Agreement warrant that:

  • they own or control the rights to the work;
  • the work does not infringe third-party rights;
  • the work is not defamatory or unlawful;
  • inclusion of third-party personal data complies with applicable law;
  • they have legal capacity to contract.

Detailed warranties are set out in Publishing Agreements.

9. Indemnity

Indemnity obligations, where applicable, are defined exclusively in the relevant Publishing Agreement.

10. Limitation of Liability

Website Use

Liability arising solely from use of this website shall not exceed £100, subject to clause 10.4.

Publishing Services

Liability arising under a Publishing Agreement shall not exceed the total fees paid for the specific services giving rise to the claim.

Excluded Losses

To the extent permitted by law, Noble Legacy shall not be liable for:

  • loss of profits or revenue;
  • loss of business opportunity;
  • indirect or consequential losses;
  • losses arising from third-party platform actions;
  • losses arising from author marketing decisions.
Non-Excludable Liability

Nothing excludes liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • breach of statutory consumer rights;
  • any liability that cannot lawfully be excluded.

11. Third-Party Platforms

Noble Legacy is not responsible for policy changes, account suspensions, algorithm adjustments, reporting discrepancies, tax withholding, or payment processing conducted by third-party platforms.

12. Submission of Materials

Submission of enquiries or materials does not create contractual obligations.

Noble Legacy reserves the right to decline submissions.

No liability is accepted for unsolicited materials.

Submission does not establish confidentiality unless agreed in writing.

Submission of an enquiry does not constitute a contractual obligation, nor does it guarantee editorial review, project acceptance, or publication.

13. Data Protection

Use of this website and services is subject to our Privacy Policy.

14. No Partnership

Nothing in these Terms creates partnership, joint venture, fiduciary duty, or employment relationship.

15. Force Majeure

Noble Legacy shall not be liable for delays caused by circumstances beyond reasonable control.
